By purchasing Lumicios Spanish Services, I agree to the terms of this Agreement:

①  Services

Lumicios Spanish shall    provide teaching and tutoring Services to clients with respect to matters related to spanish consulting Services. Lumicios Spanish will provide the specific Services purchased by client (collectively, the “Services”).

②  Time and Availability

Lumicios Spanish shall have discretion in selecting the dates and times it performs such teaching Services giving due regard to the client’s needs. If Lumicios Spanish client requires more Services at any time, Lumicios Spanish is not obligated to undertake such work.

③  Payments

The client can choose packages from our plans. Payments can be made through PayPal or Stripe. Refunds can be made after the conditions in the policy has been met.

④  Confidentiality

All communications between Lumicios Spanish and client are strictly confidential. All advice given to client is for his or her exclusive use only and shall not be shared with anyone else under any circumstances.

⑤  Exclusion from Services

Lumicios Spanish’s provision of the Services to/for me is limited to the exact Services purchased. Lumicios Spanish shall owe me no duty of ongoing Services in this or other matters. Lumicios Spanish’s duties to me under this agreement will end when the retainer time has been used up and/or Services completed according to an agreed duration and/or frequency. After that time, Lumicios Spanish’s Services with me pursuant to this Agreement will cease. Any future Services are not a part of this engagement and will be covered by a separate agreement.

⑥  Termination of Services

Either of us can terminate this relationship at any time for any reason by giving written or verbal notice to the other party. Upon termination by either party for any reason, I agree and acknowledge that refunds can be made after the conditions in the policy has been met.

⑦  My Responsibilities

I agree that I will cooperate with Lumicios Spanish in its delivery of the Services and will provide it with truthful responses to all questions that I am asked pursuant to this Agreement. I further agree to immediately notify Lumicios Spanish if anything occurs that changes the answers I have previously supplied or could impact the delivery of the Services. If I decide not to utilize purchased Services, I agree and acknowledge that the Services will expire after one year of the original purchase date and no refunds will apply.

⑧  Recording of Sessions

I acknowledge that Lumicios Spanish has the right to record sessions (meetings, evaluations, classes, trial classes, etc.) for record-keeping, quality assurance, and training purposes and that I may watch or listen to any such recordings with the express permission of Lumicios Spanish. I agree that I shall not distribute any such recordings of session or otherwise use same for any purpose, except as agreed to by Lumicios Spanish. I further agree that I shall not record any sessions under any circumstances.

⑨  Further Agreements

By purchasing Lumicios Spanish’s Services I agree to the following: I release Lumicios Spanish, including its associated employees, consultants and contractors (all of whom shall be referred to as “Lumicios Spanish”) and discharge Lumicios Spanish from all claims, demands, or actions by me, on the basis of the discussions and interpretations of Lumicios Spanish.  Consideration for this release and disclaimer of liability on behalf of Lumicios Spanish shall be the Services rendered by Lumicios Spanish. Each service requires full payment. Fees paid to Lumicios Spanish are non-refundable. No partial refunds will be issued. Lumicios Spanish reserves the right to terminate a relationship with a client for any reason and at the sole discretion of Lumicios Spanish  If a refund is issued, this amount will be determined at the sole discretion of Lumicios Spanish at the time of termination. All Services must be used within one year of purchase unless otherwise specified by Lumicios Spanish. Funds used to purchase a specific service may not necessarily be used towards the purchase of a different service. No refunds will be issued for unused Services. Advice provided by Lumicios Spanish is the intellectual property of Lumicios Spanish. Services are not transferable. All Services must take place between Lumicios Spanish and the client. Parents and significant others may participate in discussions with the express permission of the client. Guidance will not be offered directly to parents, significant others, or client sponsors. By purchasing Lumicios Spanish Services, I agree with the aforementioned under any applicable law or regulation.

⑩  Cancellations for teaching and tutoring Sessions

Cancellation for teaching, tutoring sessions and mock interview appointments must be made at least 24 hours prior to the scheduled appointment time.  Otherwise the client is charged an hour.

⑪  Editing Services

I acknowledge that I will submit a sufficient first draft of materials for editing of specified length (contact us for details). Personal statement rough drafts submitted for editing may be a maximum length as specified by Lumicios Spanish. Lumicios Spanish will not generate my materials for me. Editing Services include revisions of the originally submitted documents only. New documents or essays cannot be substituted for subsequent revisions. If all revisions purchased are not used, no refunds or transfer or funds towards a different service will be issued. Documents edited by Lumicios Spanish cannot be published without permission in writing by Lumicios Spanish.

⑫  Submission of Application Materials

Lumicios Spanish will not submit any application materials on my behalf nor will they log in to my web based application. Lumicios Spanish is permitted to use comments made by clients on the Lumicios Spanish website and in Lumicios Spanish  materials as testimonials without my express permission as long as Lumicios Spanish posts those comments without my name or identifying information. None of the academic institutions or third parties referenced in Lumicios Spanish’ materials are associated with nor endorse Lumicios Spanish.

⑬  No Guarantee

I acknowledge there is no guarantee, implied or otherwise, that the Services provided by Lumicios Spanish will improve my chances for admission to college, law school, graduate school, business school, professional school or any other degree awarding institution, nor will they improve my grade point average, increase my academic ranking/standing, raise any test score (standardized or otherwise), or improve my personal or academic record in any way. Lumicios Spanish will provide the specific Services purchased by client.

⑭  Modifications of the Service

Lumicios Spanish may add, modify or disable some of the existing features in the online classroom. Lumicios Spanish reserve the right to change or discontinue the service from time to time to make room for maintenance procedures or upgrade of system/facilities. Lumicios Spanish will not be held liable for any changes or modifications Lumicios Spanish deem necessary for the improvement of the overall site features.

⑮  Changes to the Terms of Services

Lumicios Spanish may review and update these Terms of Services at any time at our sole discretion and it is your responsibility to keep abreast of those changes. All changes are effective immediately when posted and apply to all access to and use of the Sites thereafter. Your continued use of the Sites following the posting of revised Terms of Use means that you accept and agree to the changes which are binding on you, so please check this webpage periodically for updates.

⑯  Privacy

Your use of the Sites is subject to our Privacy Policy.

⑰  Errors and Corrections

Lumicios Spanish does not represent or warrant that the Sites or any services offered through the Sites will be error-free or otherwise reliable, free of viruses, or other harmful components, or that defects will be corrected or that they will always be accessible. Lumicios Spanish may make improvements and/or changes to the Sites and their features and functionality at any time, and will use commercially reasonable efforts to avoid disrupting peak hours, though some downtime may occur. Please contact individual Instructors directly to report errors in their respective Course content.

Lumicios Spanish reserve the right to amend the Sites, and any service or material we provide on the Sites, in our sole discretion without notice. Lumicios Spanish will not be liable if for any reason all or any part of the Sites is unavailable at any time or for any period. From time to time, Lumicios Spanish may restrict access to some parts of the Sites, or the entire Sites, to Users.

⑱  Third Party Communications

Lumicios Spanish disclaims all liability for any communications directed to you from any third party directly or indirectly in connection with the Sites that you may receive and any actions you may take or refrain from taking as a result of such communications. You are solely responsible for assessing and verifying the identity and trustworthiness of the source and content of any such third-party communications. Lumicios Spanish assumes no responsibility for verifying, and makes no representations or warranties regarding the identity or trustworthiness of the source or content of any such third-party communications.

⑲  Code of Conduct

In using the Services, you must behave in a civil and respectful manner at all times. Further, you agree not to use the Sites in any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries); for the purpose of exploiting, harming, or attempting to exploit or harm minors in any way, including but not limited to, exposing them to inappropriate content, asking for personally identifiable information; or to impersonate or attempt to impersonate Lumicios Spanish, a Lumicios Spanish employee, or any other user or person or entity. Lumicios Spanish has the right, but not the obligation, to monitor all conduct on and content submitted to the Sites.

⑳  Refunds

If Lumicios Spanish or I decide to terminate the Services, I agree and acknowledge that the Services will expire after one year of the original purchase Services date and no Refunds will apply, Refunds only apply to the unused hours of the purchased Services within 365 days after the purchased services and a termination of service fee will be charged to me as follows: 

(i) $15.00 (Regular Program) termination of service fee within the 30 days after the purchased Services.

(ii) $25.00 (Regular Program) termination of service fee after 30 days or more of the purchased Services.

(iii) For Group Program hours will expire 8 weeks after attending the first group class with no refunds.

(a) You may be able to link from the Site to third party websites and third party websites may link to the Site (“Linked Sites”). You acknowledge and agree that we have no responsibility for the content, products, services, advertising or other materials which may be provided by or through Linked Sites, even if they are owned or run by our affiliates. Links to Linked Sites do not constitute an endorsement or sponsorship by us of such websites or the information, content, products, services, advertising, code or other materials presented on or through such websites. Any reliance on the contents of a third party website is done at your own risk and you assume all responsibilities and consequences resulting from such reliance.

(b) You agree that if you include a link from any other website to the Site, such link will open in a new browser window and will link to the full version of an HTML formatted page of this Site. You are not permitted to link directly to any image hosted on the Site or our products or services, such as using an “in-line” linking method to cause the image hosted by us to be displayed on another website. You agree not to download or use images hosted on this Site on another website, for any purpose, including but not limited to posting such images on another site. You agree not to link from any other website to this Site in any manner such that the Site, or any page of the Site, is “framed,” surrounded or obfuscated by any third party content, materials or branding. ㉒ Communication Agreement and User Responsibilities

By providing your phone number and enrolling in Lumicios Spanish, you agree to receive text messages related to your courses, including notifications about class schedules, changes, and reminders, as well as assistance with technical issues. As a user, you are responsible for ensuring that the contact information you provide, including your phone number, is accurate and up-to-date. Promptly updating your information in your account settings or notifying us of any changes is crucial to avoid missing important communications regarding your courses.
